TERMS & CONDITIONS
By placing an order you are offering to purchase a product on and subject to the following terms and conditions.
Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are limited to Australia and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Please see our delivery charges for further information.
When placing an order you undertake that all details you provide to us are true and accurate, that you are an authorised user of the credit or debit card used to place your order and that there are sufficient funds to cover the cost of the goods. The cost of foreign products and services may fluctuate. All prices advertised are subject to such changes.
1. Pricing
We accept Visa, Maestro, MasterCard and PayPal.
If you have paid on your debit, credit or charge card, the payment will be processed on conformation of the order at the time you 'checkout'. We will email you to confirm dispatch. Please see PayPal for information on PayPal payments. The total cost of the order is the price of the products ordered plus the delivery charge.
The Australian GST?
For all Australian customers, all prices include GST.
For Overseas Customers (Including New Zealand)
All prices are in Australian dollars. For further information regarding overseas orders, please refer to Delivery Information.
Do you convert my total into other currencies?
No. We will bill your credit card in Australian dollars and your card company will convert the charges for you.
You can use the currency converter in the shopping cart to get an estimate on what an order will cost you in your preferred currency however this should be used as a guide only.
If you have any questions about currency conversions please contact your bank or financial institution.
Further information for overseas customers
The actual price charged to overseas customers will be subject to the exchange rate applied by the customer's credit or debit card company. Customers outside Australia may also be liable for any customs/import duty, quotas, permits, product restrictions and other local requirements. These charges must be paid by the recipient of the parcel. Customs policies vary widely from country to country, therefore you are advised to check the latest applicable local requirements in your country before placing an order. We cannot be held liable for any custom or import duties.
All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to, or does not for any reason, authorise payment then you will be notified of this immediately at the check-out stage.
In assessing your request for goods or services, we may use your information for the purposes of the prevention and detection of fraud.
2. Availability
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. All prices are inclusive of GST. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the 'Total Cost'.
3. Payment
Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.
4. Discount Codes
Account discount codes - Discount codes may from time to time be offered to account holders; such codes are only redeemable via the same account holder. Please take special note of the expiry dates.
Promotional discount codes - We may from time to time offer promotional discount codes on certain products. Please take special note of the expiry dates.
5. Gift Vouchers
Gift vouchers are only valid for a limited time and the voucher must be used by the date shown on the voucher – check your voucher to find out when to use it by. Once the expiry date has passed vouchers will be void.
We’re afraid we can’t accept any responsibility for lost, stolen or deleted gift vouchers.
We’ll dispatch your gift voucher either as soon as payment has been cleared or on your specified delivery date (if this is later).
From time to time, gift vouchers may get caught in pesky spam filters, and it’s up to the recipient to check these filters. We can’t take responsibility if a gift voucher cannot be delivered to the recipient’s email address because of spam filters, firewalls, the capacity of the recipient’s mailbox or any other factors outside of our control.
6. Custom Orders
If you would like to alter the length of one of our designer pieces (i.e. make it shorter or longer) we are more than happy to help. The additional price for a custom order starts at AUD $20 per item. Please note that custom orders can not be resold therefore we will not be able to issue any refunds or exchanges.
To order a custom piece simply select the closest size and add it to your shopping cart. When you are ready to check out view the item in the cart and select the custom order button. In the open field please confirm details of the alteration (e.i. do you want it shorter and longer. Any measurement you have would be a great help to our design team).

Unfortunately we can not do any custom orders on the printed collection.
SECURITY
Your credit card details are not stored by our website, they are passed securely through eWAY's certified secure payment process. This process is constantly monitored by eWAY.
eWAY is supported by Visa and Mastercard as a secure payment gateway. eWay is a teir one PCI compliant gateway.
Your purchase is 100% secured by eWAY.
We are against credit card fraud and take a strong stance against anyone trying to use another person’s details. Any signs of fraud will be immediately reported to the Australian Police and banking authorities.
A Secured Socket Layer (SSL) with a 128 bit ensures your payment details are protected. Additionally our firewall is regularly updated.
The only details recorded and kept on our database are your personal details, e.g. emails, names, addresses. This information will never be passed on other than in case of a legal responsibility.
Payment or debiting of your card will only be made when you accept and choose to pay for the items you have ordered at the end of the checkout. Without this your order will not be recorded or processed. If you are not the cardholder listed on the credit card do not make a purchase at this store.
RETURNS
All items must be returned back to us within 21 days of the customer receiving the order. Items must be unworn, unwashed with the tags attached. Items that do not meet these criteria are non-returnable and will be denied. Please note that custom orders can not be returned, or refunded. We recommend using registered mail as we cannot be held liable for any items lost in the post.
We only offer store credits or refunds for returned items. If you are wanting to exchange your items, you will be given a store credit which you will be able to use towards your next order :)
Please be aware that your new order will be processed through as per normal, and we cannot fast track any new orders processed :( sorry.
This is only so that we can process all returns as fast and efficiently as possible for you :)
SHIPPING
1. Australia
We offer an Australia Post & Fastway Express Delivery service only.
Please note that most of our gear is made to order especially for you, so delivery time is based on when it is manufactured. Your patience is appreciated. :)
Delivery within 3 working days (if item is in stock): $10.00 (AUD)

- Your orders will be sent out via Australia Post or Fastway Express Post service.
- Each parcel is trackable and requires a signature upon delivery. If you think you will not be present at delivery then please leave a note (at checkout) to give permission for it to be left in a secure place without a signature. Otherwise, a note will be left and you will be required to pick up the package from the Australia Post Office as specified on the note.

Unfortunately we can not deliver on a public holiday. In this instance please expect your delivery on the next working day.
2. International
We offer the option to select Standard or Express delivery services.
Standard Delivery is through Australia Post and is NOT trackable. Delivery time is usually between 1 - 3 weeks on stocked items.
Express Delivery is through FedEx and is fully trackable. Delivery time is usually between 4 - 7 working days on stocked items.

We recommend using FedEx as this service is fully trackable. If you use the Standard Delivery service we cannot be held liable for any lost items.
When you place an order, we suggest you have it delivered to a work address rather than a home address, as our couriers only deliver between 9am and 5pm, and will require a signature on receipt.
In some countries customs or import duties may be charged. These charges must be paid by the recipient of the parcel. We have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you may want to contact your local customs office for further information.
Once your parcel has arrived in your country, standard shipping parcels will be passed on to the internal postal service, according to standard delivery procedures.
If you aren't available when your parcel is delivered, the delivery driver will leave a calling card with instructions on how to pick it up. FedEx will try delivering for 3 consecutive business days. If unsuccessful, FedEx will notify us to help contact the customer for an alternative option such as redirection/return to sender. If we can not contact the customer within 5 business day the package will be destroyed by FedEx. We can not be held accountable for any packages destroyed by FedEx.
3. Tracking
All orders within Australia are trackable via Australia Post or Fastway.
All parcels sent using International Express Shipping are trackable via FedEx.
Please note there is no tracking on the International Standard Shipping option.
4. Gift Vouchers
Gift Vouchers are sent electronically via email only. Ask the recipient to check that their gift voucher is not caught in their junk mail, spam or firewalls. If you have any issues or questions please contact us at hello@blackmilkclothing.com.
COMMUNITY AREAS
1. Registration
Black Milk Clothing reserves the right to close accounts if any user is seen to be using proxy IPs (Internet Protocol addresses) in order to attempt to hide the use of multiple accounts or disrupts any of our services in any way.
If you use multiple logins for the purpose of disrupting the community you may have action taken against all of your accounts.
2. Submission of material
By submitting any material to us, you automatically grant Black Milk Clothing the royalty-free, perpetual, exclusive right and license to use, reproduce, modify, edit, adapt, publish, translate, create derivative works from, distribute, perform and display such material (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. You also acknowledge that Black Milk Clothing is not obliged to publish any material submitted by you on any Black Milk Clothing publication.
We advise that you never reveal any personal information about yourself or anyone else (telephone number, home address, business address, delivery address or email address or any other details that would allow you to be personally identified). In certain circumstances Black Milk Clothing may also share your contribution with trusted third parties. By submitting any material to us, you agree to use the Black Milk Clothing Community Guidelines as specified on this page.
3. Failure to comply
If you fail to abide by these Community Rules you may be sent an email which informs you why your contribution has been refused or edited. This email will also include a warning that continuing to break the rules may result in action being taken against your account or accounts. This action may include any content posted by you being checked before allowed to go on the site or a temporary or permanent suspension of your ability to participate in any or all areas of Black Milk Clothing.
Black Milk Clothing reserves the right to delete any contribution, or take action against any account, at any time, for any reason. If you do not want to grant Black Milk Clothing the permission set out above on these terms, please do not submit or share your contribution on the Community website.
